Terms & Conditions
Last updated: 9 May 2024
These terms set out the basis on which Express Import provides its vehicle sourcing, import, type approval and registration service. Please read them carefully. By requesting a quotation or placing an order with us, you agree to these terms.
1. About us
Express Import (“we”, “us”, “our”) operates from 123 Bell Yard, London, United Kingdom. You can contact us at sales@expressimport.co.uk.
2. Our service
We provide a managed vehicle import service. Depending on what is agreed in your quotation, this may include sourcing a vehicle from an overseas supplier, arranging international freight, handling export and import customs formalities, arranging UK type approval, and completing UK registration before handover.
Vehicles listed on this website are shown to illustrate what we are able to source. Listing a model does not mean a vehicle is in stock or immediately available. Availability, specification and price are confirmed in your individual quotation.
3. Quotations and pricing
- Quotations are personal to you and are valid for the period stated in the quotation.
- Your quotation sets out the total price and what it includes, which will typically cover the vehicle, international freight, customs duties, VAT, type approval and registration fees.
- Prices shown elsewhere on this website are indicative only and are not an offer to sell.
- The price agreed in your quotation is fixed, save where clause 4 applies.
4. Changes in cost outside our control
In limited circumstances the total cost may change after your order is placed — for example where duty rates, taxes or statutory fees change, where you request a change to the specification, or where an exchange rate mechanism has been expressly agreed in your quotation. We will tell you as soon as we become aware of any such change and, where the increase is material and not caused by a change you requested, you may cancel and receive a refund of sums paid, less costs we have already reasonably and irrecoverably incurred on your behalf.
5. Orders and payment
A binding contract is formed when you sign our import agreement and we receive your deposit. Unless your quotation states otherwise, payment is due in three stages:
- 30% deposit on signing the import agreement.
- 60% before the vehicle departs the factory or port of origin.
- 10% on delivery and handover.
We are not obliged to release a vehicle, or to transfer ownership, until the full price has been received in cleared funds.
6. Timescales
Indicative timescales are given in your quotation. Vehicles already at port are typically delivered within 6–9 weeks, and factory orders within 8–11 weeks, covering shipping, customs clearance, approval and registration.
These timescales are estimates. International shipping, customs inspection, approval scheduling and manufacturer production are not wholly within our control, and delays can occur. We will keep you informed of any material change and will not be liable for delays caused by matters outside our reasonable control.
7. Specification
The vehicle supplied will match the specification recorded in your quotation and order. Manufacturers occasionally make minor changes to equipment, materials or finishes during a production run. Where a change is minor and does not materially affect the vehicle's value or your use of it, we may supply the vehicle as changed. Where a change is material, we will contact you and you may accept the change or cancel and receive a refund of sums paid.
8. Type approval and registration
Imported vehicles must satisfy UK approval requirements before they can be registered. Where included in your quotation, we will arrange the necessary approval and complete UK registration so that the vehicle is road legal at handover. You agree to provide promptly any identification, proof of address or other documentation reasonably required to complete registration in your name.
9. Delivery, risk and title
- Delivery takes place at handover, at our premises or at another location agreed with you.
- Risk in the vehicle passes to you on handover.
- Title passes to you once we have received the full price in cleared funds and the vehicle has been handed over, whichever is later.
- You are responsible for arranging insurance from the point of handover.
10. Warranty and aftersales
Warranty cover is confirmed in your quotation and depends on the model and configuration. Where a third-party warranty is provided, it is subject to that provider's own terms, which we will make available to you. Regardless of warranty status, we provide aftersales support and can arrange servicing and parts through our partners.
Nothing in these terms affects your statutory rights in respect of the vehicle supplied.
11. Your rights if something is wrong
If you are a consumer, you have legal rights under the Consumer Rights Act 2015. Goods supplied must be of satisfactory quality, fit for purpose and as described, and services must be carried out with reasonable care and skill. Nothing in these terms limits or excludes those rights.
12. Cancellation
You may cancel at any time by notifying us in writing. Where you cancel after the contract is formed, we will refund sums paid less any costs we have already reasonably and irrecoverably incurred on your behalf — which may include supplier deposits, freight and approval costs, and which can be substantial once a vehicle has been ordered or shipped.
Because vehicles are sourced and configured to your order, the cancellation rights that apply to certain distance contracts may be limited or may not apply. Where a statutory right to cancel does apply to your contract, we will say so in your import agreement and explain how to exercise it. This clause does not affect your right to reject faulty goods.
13. Our liability
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
Subject to that, we are not liable for loss of profit, loss of business, or any indirect or consequential loss, and our total liability arising under or in connection with a contract will not exceed the total price paid by you under that contract.
14. Events outside our control
We are not liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including shipping disruption, port or customs delays, changes in law or trade restrictions, manufacturer production stoppages, extreme weather, fire, flood, or industrial action.
15. Complaints
If you are unhappy with any aspect of our service, please contact us at sales@expressimport.co.uk. We aim to acknowledge complaints promptly and to resolve them fairly.
16. Privacy
We handle your personal data in accordance with our Privacy Policy.
17. General
- We may update these terms from time to time. The terms that apply to your order are those in force when your order is placed.
- If any provision is found to be unenforceable, the remaining provisions continue in force.
- You may not transfer your rights under a contract without our written consent.
18. Governing law and jurisdiction
These terms and any contract between us are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
